HIPAA Notice of Privacy Practices Solace Telepsychiatry, PLLC

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
1. Our Relationship with Mindful Therapy Group
Solace Telepsychiatry, PLLC is an independent business owned and operated by Catherine Ren Wu. We work with Mindful Therapy Group (and its administrative arm, Mindful Support Services) for office management, billing, scheduling, and electronic health record (EHR) hosting.

Organized Health Care Arrangement (OHCA): Solace Telepsychiatry participates in an OHCA with Mindful Therapy Group and other independent providers at MTG. This allows us to share your Protected Health Information (PHI) with MTG administrative staff and other clinicians in the group as necessary for joint healthcare operations, coordination of your care, and payment processing.

Business Associate: Mindful Therapy Group acts as our "Business Associate," meaning they are legally contracted to protect your data with the same level of security required of a medical practice.
2. Uses and Disclosures of Your Health Information

Treatment: We share PHI with MTG staff to schedule appointments and with other providers involved in your care to coordinate treatment.

Payment: We provide necessary PHI to MTG’s billing department to process insurance claims and collect payments on our behalf.

Healthcare Operations: We use PHI for quality assurance and practice management within the MTG ecosystem.
3. Special Protections for Mental Health & SUD Records
As a psychiatric practice in Washington State, we provide additional safeguards:

Psychotherapy Notes: These are private notes kept separate from your medical record. We will not release these without a specific, separate authorization from you, except in very limited legal or safety circumstances.

Substance Use Disorder (SUD) Records (42 CFR Part 2 - 2026 Update): If your records contain information from a federally assisted SUD program:

They will not be used in any legal proceedings against you (civil, criminal, or administrative) without your specific written consent or a specialized court order.

You have the right to request an "accounting of disclosures" specifically for these records.

Washington State Law (RCW 70.02): We comply with Washington’s stricter privacy laws regarding mental health and HIV/AIDS information.
4. Your Rights

Right to Access: You may request a copy of your records through the MTG Patient Portal. Under HIPAA, MTG will provide these within 15 working days (per RCW 70.02.080) and up to 30 days (federal law).

Right to Amend: You may ask us to correct information in your record that you believe is inaccurate.

Right to Limit SMS/Email: You may opt out of receiving appointment reminders via SMS or email at any time by notifying us or the MTG front desk.

Out-of-Pocket Payments: If you pay for a session in full out-of-pocket, you have the right to request that we do not share that information with your health insurance plan.
5. Complaints
If you believe your privacy has been violated, you may contact our Privacy Officer (Catherine Ren Wu) or the MTG Privacy Officer. You may also file a complaint with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
